By using our website or engaging our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our Services.

3. Our Services

We offer:

• Data engineering, modelling, and analytics consulting
• Custom agentic AI solutions
• SaaS products (such as ShortList AI)
• Feasibility studies and proof-of-concept projects

All services are provided subject to these Terms and any specific agreement or proposal signed with you.

4. User Accounts

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract our AI models or proprietary technology
• Upload harmful code, viruses, or malicious content
• Share access credentials with unauthorised persons

6. Intellectual Property

• All content, tools, platforms, and AI models provided by Bifurcate.ai remain our exclusive intellectual property.
• You are granted a limited, non-exclusive, non-transferable licence to use our Services during the term of your subscription or engagement.
• Any custom solution developed for you will transfer ownership as specified in your separate project agreement.

7. Data Ownership & Licence

You retain ownership of your data. By using our Services, you grant us a limited licence to access, process, and use your data solely to provide the Services and improve our offerings (where permitted).

8. Fees and Payment

• Pricing is as quoted or listed on our platform.
• Payments are non-refundable except as required under the Australian Consumer Law.
• We may suspend access for non-payment.

9. Warranties and Disclaimers

Our Services are provided "as is". While we strive for high quality, we do not guarantee uninterrupted access, error-free performance, or specific outcomes from AI recommendations.

We comply with the Australian Consumer Law consumer guarantees where they apply.

10. Limitation of Liability

To the maximum extent permitted by law, Bifurcate.ai's total liability to you will not exceed the total amount paid by you in the 12 months preceding the claim.

We are not liable for indirect, consequential, or incidental damages, including loss of profits or data.

11. Termination

We may suspend or terminate your access if you breach these Terms. You may cancel your subscription in accordance with the specific product terms.

12. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the Victorian courts.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or website notice. Continued use of the Services after changes constitutes acceptance of the new Terms.
